General Terms and Conditions for the Use of the WWT Software
1. Scope:
1.1. These terms of use govern the legal relationship and code of conduct between
the World Wide Treasures (WWT) sales and marketing software and the registered users
of this B2B and B2C online software. These terms also govern the use
of the online software WWTreasures.com, including the use of the WorldWideTreasures
website, regardless of the device or operating system used.
1.2. Deviating terms and conditions of the user shall only apply if and to the extent
that they are acknowledged in writing by WWTreasures.com.
2. Registration and User Account:
2.1. Use of the services and functions available on WWTreasures.com requires
registration and signing in as a user. It is important to note, however, that
WWTreasures reserves the right to place user applications on the waiting list
or reject them without stating reasons.
2.2. Registration and sign-in are only permitted for users who are of legal age and
have full legal capacity. Registration and sign-in for minors is prohibited.
2.3. By submitting the registration form, the user offers to conclude a user agreement
with WWTreasures.com. If WWTreasures.com accepts the registration, the user will
receive a confirmation email with a personalized activation link. The agreement
for the use of WWTreasures.com services and these terms and conditions
will enter into force upon confirmation of the activation link.
2.4. Once successfully registered, a user account is created for the user, which can be accessed using the user’s email address and password. The password can be changed at any time in the user area, accessible at
www.wwtreasures.com/en/identity. The user must keep the password secret and protect it from unauthorized third-party access. If the user becomes aware or suspects that their access data is being used by a third party, they must immediately notify WWTreasures.com and change their password without delay.
2.5. Each user may only register once for the respective commercial or freelance use of WWTreasures.com services. User accounts are non-transferable. In the event of violations, WWTreasures.com reserves the right to suspend or delete one or all user accounts. Upon deletion of the user account, re-registration with the previously used email will automatically be made available again within 30 days.
3. User Obligations:
3.1.1 The user is obliged to provide only true, non-fraudulent, or non-misleading information on WWTreasures.com and in communication with other users, and the listed offers must be real and existing. Upon request by WWTreasures.com, the user must provide proof of the existence of the listed offers. Publishing false or non-existing offers, as well as false profiles, is prohibited and may result in temporary or complete account suspension, extraordinary termination by WWTreasures.com, and/or the assertion of claims for damages, and/or the communication to or visibility of such infractions to other users.
3.1.2. Only enter information in data fields that are designated for that type of information, and do not enter contact information in places other than those provided for such data.
3.1.3. Ensure that the information provided on WWTreasures.com is accurate and up to date. Product listings must be removed when they are no longer available, and sellers must keep availability information updated. WWTreasures.com may take appropriate action, including removing outdated or non-existent offers, and reserves the right to take profiles or offers offline if they have not been updated for three years.
3.1.4. Only publish content (including profiles or product descriptions) that is relevant to WWTreasures.com’s purpose, which is to facilitate a direct relationship between users (or, in the case of brokers, between a user and the broker's customer), or the factual commentary on posts by WWTreasures.com. Non-personalized or irrelevant posts (e.g., mass mail or chain mail) are not permitted.
3.1.5. Keep account access data (username, password) confidential and do not share it with third parties.
3.1.6. Treat all information and data received from other users as confidential and do not share it with third parties unless it is obvious that the user is acting as a broker, in which case the broker may share information only to the extent necessary for their purpose.
3.1.7. Use the account only personally or by an authorized representative and not offer or transfer services obtained from WWTreasures.com to third parties without WWTreasures.com’s permission.
3.1.8. For users with multiple accounts (e.g., for employees), each account must only be used by one individual. WWTreasures.com reserves the right to monitor this restriction. Violations may result in a fine determined at WWTreasures.com’s discretion.
3.1.9. Refrain from actions that could damage WWTreasures.com’s infrastructure, impair secure operation, or harm other users.
3.1.10. Do not publish illegal content on WWTreasures.com or infringe on third-party rights, including, but not limited to, offensive, defamatory, pornographic, or other illegal content. This applies to WWTreasures.com’s social media profiles as well.
3.2. Users guarantee that they own all necessary rights to the content they upload and that no copyright, trademark, or competition law violations occur.
3.3. It is prohibited to process or trade with data obtained through WWTreasures.com commercially or advertise products or services that compete with WWTreasures.com. Violations trigger a penalty determined by WWTreasures.com, which can range between EUR 50,000 and EUR 100,000 per breach, with further claims reserved. Penalties may be credited towards claims for damages.
4. Content Removal, User Blocking, User Liability:
4.1. WWTreasures.com reserves the right to delete user content or prevent its publication if it is illegal, violates decency or third-party rights, is incompatible with the purpose of WWTreasures.com, or is otherwise unreasonable. The same applies if the content’s accuracy is disputed between users until resolution. WWTreasures.com may also correct spelling or other obvious errors.
4.2. If a user violates their obligations under this agreement, WWTreasures.com is entitled to temporarily block the user account or terminate the contract for good cause.
4.3. Users shall indemnify WWTreasures.com from any third-party claims arising from their content. This includes legal costs at statutory rates. The user shall provide all necessary information to WWTreasures.com if required for the defense against such claims.
4.4. WWTreasures.com may temporarily block data that is in dispute or that a third party reasonably claims infringes its rights.
5. Liability:
5.1. WWTreasures.com is not responsible for the accuracy, completeness, or legality of user-provided information. Content posted on WWTreasures.com or on WWTreasures.com’s social media pages does not reflect WWTreasures.com’s opinions and is not reviewed for accuracy, completeness, or legality.
5.2. WWTreasures.com is only liable for damages if they are caused by WWTreasures.com, its legal representatives, or agents due to gross negligence or intent, or if caused by a breach of essential contractual obligations.
5.3. If liability arises from a breach of essential contractual obligations without gross negligence or intent, or from gross negligence or intent by non-executive employees, WWTreasures.com’s liability is limited to the typical, foreseeable damage, which does not exceed the annual usage fee.
5.4. Liability for injury to life, body, or health, or for assumed guarantees, remains unaffected.
5.5. WWTreasures.com explicitly distances itself from linked content and is not liable for the content of external links.
6. Data Protection:
6.1. WWTreasures.com collects, processes, and uses user data in accordance with applicable data protection laws.

7. Termination of the Contract
7.1. The contract between the user and WWTreasures.com may be terminated by either party at any time without providing reasons.
7.2. The right to extraordinary termination for good cause remains unaffected. Good cause includes, but is not limited to, the violation of legal provisions, essential contractual obligations, or significant harm to WWTreasures.com’s reputation.
7.3. Upon termination, WWTreasures.com may delete all user-published content.
